Toledo's texting ban penalties start Jan. 1

By a vote of 10-2 on Tuesday the Toledo City Council voted to impose on ban on sending or receiving text messages while driving . The new law goes into effect Jan.1, 2010.

First time offenders could face a minor misdemeanor charge that could result in a fine of up to $100. A second offense is a 3rd degree misdemeanor with the potential for a $500 fine and up to 30 days in jail and a third offense is a 2nd degree misdemeanor that could result in a $750 fine and up to 90 days in jail.
